The legal system preaching is all well and good, but the legal system failed when it allowed the 18-year-old to be bailed out in the first place.

Oh. Well, that's up to the judge to decide how much to post bail for. These things typically take into account flight risk, the danger the person may potentially pose on others, that sort of thing.
In which case yes, as the victim lives with the perpetrator, I don't know why bail was posted at all. What kind of toxic man-thing is happening now? |

I don't know if this is really something I condone but I'd like to think that since this kid was caught in the act that they'd have enough evidence to convict him. The father really should have sat down for a minute to think about a few things; like that his stepson could have gone away for a long time to a place where daily gangrape and brutal beatings are mandatory for creeps like this. Now he's probably going to join the kid in the defense side. :/

But, since it was the dad that anally raped his stepson with a wrench, and the father is INDEED a man, even a temporary insanity case will be shot down because he has a pair of testicles. Which, I don't know about a lot of people, but I believe that the father would have been just as psychologically damaged as his daughter is right now. Even moreso given the fact that it was his stepson. But, also you got to admit that the news article in question did a DAMN good job in outlining that the father seemed like a scumbag criminal in the fact they listed about everything he did wrong in his life. So it's give or take. Jam it back in, in the dark.

Even if the perp had ovaries I don't think temporary insanity would work as this was clearly premeditated. Let's say you're able to suspend disbelief on the father picking up the kid thinking he'd be okay, and then suddenly loosing it. He'd have to take the wrench and bat with him, or mull over what he was going to do as he drove to that abandoned house. Temporary insanity is just that, temporary. The only way a jury would buy temporary insanity is if they just don't want to convict the guy to begin with.
