The legality of TPB has been looked into by Swedish prosecutors in the past and it's been deemed that there's nothing there to press charges against. So in a sense this has happened before, it's just on a larger scale now due to the more direct involvment of the MPAA and the US goverment.

I was just reading the MPAA press release and I'm currently :eyebrow:

I wish they'd atleast stop with idiotic shit like "The major motion picture studios lost an estimated $6.1 billion to piracy in 2005".

Don't forget that mininova and torrentspy are sites that just catalog torrents and don't run trackers of their own. So this may cause problems for people who didn't use TPB directly, as well.

That's essentially what happened. But the controversy lies in the descision by our minister of justice to go above the police and prosecutions office and force the police into taking this action. There being no legal grounds/reasons to do the raid and confiscate TPB servers.
