Well dating a friends ex (especially soon after the break-up) can be a little tricky, you situation doesn't seem that difficult. I mean, they have been broken up for 3 years.
It's very simple. Ask him. Don't play stupid girl games. Simply come right out and say "I've been talking with _____ alot lately, would it be a problem if we went on a date sometime". He will say yes or no. You will now know what to do. If he says "no" and he really means "yes" then fuck him, he's obviously not mature enough to be taking advice from anyways.
