No, because there are portions of the waveform that do not require 320kbps. When your song contains a few moments of specific sound that would only need say 96kbps to faithfully replicate, demanding 320CBR is ridiculous.

'Variable' in this context doesn't mean 'random;' it indicates that the bitrate shifts to accommodate the file's waveform. Since you're sampling the same song twice, it should be obvious that you're going to get the precise VBR behavior both times.
